The Civil Enforcement Act allows a Bailiff on behalf of a landlord to seize a tenant’s property to recover rental arrears. Under a Distress Warrant, Landlords are able to seize vehicles registered to the tenant as well as goods in the suite.
It is important to note that:
- a Distress Warrant must be enforced before a Notice to Terminate (if given) expires
- there are some goods exemptions that apply
- Landlord Distress does not force the tenant to move out of the premises (an Order of Possession will still be required)
- the tenant may not have any goods to seize worth the cost and effort
